Appeals

APPEALS TO THE CHIEF EXECUTIVE

Any person who is aggrieved by the Authority’s decision on the refusal, withdrawal, revocation, variation, or suspension of an aviation document may appeal to the Chief Executive for the review of the Authority’s decision as required under section 12F of the Civil Aviation Authority of Fiji Act 1979 (Act).

Section 12F of the Act provides:

Any person who is aggrieved by the Authority’s decision on the refusal, withdrawal, revocation, variation, or suspension of an aviation document may appeal to the Chief Executive for the review of the Authority’s decision.

APPEALS PROCESS

In total, the appeals process to the Chief Executive usually takes 28 to 35 consecutive days to complete depending on the complexity of the matter.

In summary, the appeals process involves:

​​​​​​​Step 1 - Applicant appeals to the Chief Executive.

  • A person who is aggrieved by the Authority’s decision on the refusal, withdrawal, revocation, variation, or suspension of an aviation document (‘Applicant’) must as soon as practicable write a letter to the Chief Executive requesting an appeal (‘appeal letter’).
  • In that appeal letter, the Applicant must include a written representation of his or her case.

Step 2 – Acknowledgement

  • The Chief Executive acknowledges receipt of the appeal letter to the Applicant with a brief overview of the appeals process and the timeline with which the review of the Authority’s decision is to be made.

Step 3 – Representations

  • The appeals process involves representations to be made by both the Applicant and the Controller or Department head who made the decision on behalf of the Authority to the Chief Executive.
  • Both parties will be given an opportunity to respond to each other’s representations before the Chief Executive reviews and decides.
  • Depending on the complexity of the matter, this step may take up to 21 consecutive days.

Step 4 – Review and Decision by the Chief Executive

  • After receiving representations from both the Applicant and the Controller or Department head, the Chief Executive conducts the review, makes a decision and informs the Applicant of the decision in writing.
  • Depending on the complexity of the matter, this step may take up to 14 consecutive days.
